Breaking a lease in Geneva — what does Swiss law say?
Under Article 264 of the Swiss Code of Obligations (CO), any tenant can return their apartment before the lease end date, provided they present a solvent replacement tenant who is ready to take on the lease under the same conditions. The landlord or property management agency must accept the replacement unless they have an objective reason to refuse (e.g. the candidate is insolvent or unwilling to continue on the existing terms).
This right applies equally to Swiss nationals and foreigners — including expats working for international organizations such as the UN, WHO, CERN, UNHCR, WTO, ICRC or multinational companies. It covers both furnished and unfurnished apartments, as well as commercial leases.
