Early lease termination in Switzerland — the full legal picture
Article 264 of the Swiss Code of Obligations is a mandatory statutory provision — meaning it cannot be waived or excluded by a lease contract. Even if your rental agreement contains clauses that suggest you are bound until a specific end date, Article 264 CO overrides those clauses and gives you the right to leave early.
The only condition is that you present at least one solvent and willing replacement tenant to your landlord. The replacement must meet standard solvency criteria: a net income of at least 3 times the monthly gross rent, a clean record from the debt enforcement office (Office des poursuites), and a complete application dossier.
If the landlord refuses the replacement without a legitimate reason, you are entitled to be released from the lease after 30 days from the date you presented the candidate — regardless of the lease end date.

What does "solvent replacement tenant" mean exactly?
A solvent replacement tenant is someone who earns at least 3 times the monthly gross rent (net income), has a clean record at the Office des poursuites (no outstanding debts or judgments), and is willing to take on your lease under exactly the same conditions — same rent, same duration, same terms.
