For expats, lease flexibility is critical. Postings end unexpectedly, contracts are renewed elsewhere, or families decide to relocate. Yet Geneva's standard residential leases often run for several years. This is where Article 264 of the Swiss Code of Obligations becomes essential knowledge.
Under Art. 264 CO, any tenant — regardless of nationality or employer — can exit their Swiss lease early by presenting a solvent replacement tenant willing to take over on the same conditions. The landlord cannot refuse without objective reason. If they do refuse unreasonably, the tenant is released after 30 days anyway.

Yes, in most cases. The average timeline is 3–5 weeks: 1–2 weeks to find a qualified candidate, then 2–3 weeks for validation by your landlord or agency. Geneva's tight rental market means candidates are found quickly. Start as early as possible to maximise the chances of a smooth handover.
My employer is relocating me. Should they cover the lease costs?
Some relocation packages include a "lease break" allowance, but many do not. Regardless of what your employer covers, you have the right under Article 264 CO to exit your lease without penalty as long as you present a qualified replacement tenant. monbail.ch makes this process free and simple.
Can I start the process remotely if I have already left Geneva?

I work for an international organization (UN, WHO, CERN…). Are there any special considerations?
International organization employees have the same rights as any other tenant under Swiss law. There are no special lease provisions for IO employees unless specifically negotiated in your contract. Article 264 CO applies in full.
What about the apartment deposit (caution locative)?
Your deposit (typically 2–3 months' rent, held in a blocked bank account) is returned after you have vacated the apartment and the state-of-exit inspection confirms no damage beyond normal wear and tear. This is a separate process from the lease transfer and happens regardless of how you exit your lease.
